WorkCover NSW can prosecute business owners for a variety of criminal offences.

In particular WorkCover may prosecute business owners where

  • An accident has occurred where a worker (or other person) has died or been injured
  • Where unsafe work methods or conditions are assessed to exist

Offences under relevant Work Health Safety legislation carry significant penalties for both individuals and companies.

Examples include penalties of

  • for offences where a failure to discharge a work health safety duty exposes an individual to a risk of death or serious injury or illness.( fines up to $3m for a corporation, $600,000 for an individual and/or 5 years imprisonment)

for offences where a person or business fails to comply with a work health safety duty ( fines up to $500,000 for a corporation, $100,000 for an individual)
